Acceptance Of Terms
Wheelersgate provides a collection of online resources website, which may include
classified ads, quotation services, price listings, forums, various email services,
etc (referred to hereafter as "the Service") subject to the following Terms of Service
("Terms"). By using the Service at
http://www.wheelergate.com.my/ ("Site") in any way, you are agreeing to
comply with these Terms. In addition, when using particular Service, you agree to
abide by any applicable posted guidelines for all Wheelersgate services. Should
you object to any term or condition of these Terms, any guidelines, or any subsequent
modifications there to or become dissatisfied with Wheelersgate in any way, your
only recourse is to immediately discontinue use of Wheelersgate.
Variation Of The Agreement
Wheelersgate reserves the right, at its sole absolute discretion, to change, modify,
add or remove any portion of the Agreement, in whole or in part, at any time, and
such modifications shall be effective immediately upon posting of the modified Terms
of Service. You agree to review the Agreement periodically to be aware of such modifications
and your continued access to or use of the Service shall be deemed your conclusive
acceptance of the modified Terms of Service.
Use Of Services
In consideration of your use of Service, you represent that you are of legal age
to form a binding contract and are not a person barred from receiving services under
the laws of the Malaysia or other applicable jurisdiction. If you do not meet the
above legal age, please do not use the Service.
In order to access certain Service, you may be required to provide current, accurate
identification, contact, and other information as part of the registration process
and/or continued used of the Service offered by Wheelersgate and its subsidiaries
or affiliated companies. You are responsible for maintaining the confidentiality
of your Wheelersgate account and password and are responsible for all activities
that occur under your account.
You agree and undertake to immediately notify Wheelersgate of any unauthorized use
of your password or account or any other breach of security. Wheelersgate cannot
and will not be liable for any loss or damage whatsoever arising from your failure
to comply with this Section 1. Further, your Wheelersgate account and User ID cannot
not be transferred or sold to another party without the express written consent
of Wheelersgate.
Wheelersgate reserves the right to refuse service to any particular person, or to
block access from a particular Internet address to Wheelersgate, at anytime without
ascribing any reasons whatsoever and Wheelersgate will be not be liable for any
loss or damage whatsoever arising therefrom.
Content and Related User Conduct
You understand that all information, data, text, messages, files, images, photographs,
video, sounds, or other materials ("Content") posted on, transmitted through, or
linked from the Service, are the sole responsibility of the person from whom such
Content originated. More specifically, you are entirely responsible for all Content
that you post, email or otherwise make available via the Service. You agree and
undertake not to cause, nor knowingly allow others to cause any nuisance, annoyance,
or inconvenience, whether to Wheelersgate or any of its customers or users of the
site by any means. You understand that by using the Service, you may be exposed
to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable
and that you are using Wheelersgate at your own risk.
You understand that Wheelersgate does not fully control, and is not responsible
for Content made available through the Service. Any Content that Wheelersgate gathers
are from advertisers or based on algorithms that's believed to be reliable, but
no assurance can be given that this Content is accurate, complete or current. Wheelersgate
does not assume responsibility of errors or omissions or warrant the accuracy of
this Content.
You acknowledge that Wheelersgate does not 100% pre-screen or approve all its Content,
but that Wheelersgate shall have the right (but not the obligation) in its sole
absolute discretion to monitor, refuse, delete or move any Content, in whole or
in part, that is available via the Service, for violating the letter or spirit of
the Terms or for any other reason.
As a condition of you use of the Site, You agree and undertake not to upload, post,
email, or otherwise publish through this Site any Content:
- that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous,
invasive of another's privacy, or is harmful to minors in any way;
- that is pornographic or depicts a human being engaged in actual sexual conduct including
but not limited to (i) sexual intercourse, including genital-genital, oral-genital,
anal-genital, or oral-anal, whether between persons of the same or opposite sex,
or (ii) bestiality, or (iii) masturbation, or (iv) sadistic or masochistic abuse,
or (v) lascivious exhibition of the genitals or pubic area of any person;
- that harasses, degrades, intimidates or is hateful toward an individual or group
of individuals on the basis of religion, gender, sexual orientation, race, ethnicity,
age, or disability;
- that impersonates any person or entity, including, but not limited to, a Wheelersgate
employee, or falsely states or otherwise misrepresents your affiliation with a person
or entity (this provision does not apply to messages that are lawful non-deceptive
parodies of public figures.);
- that includes personal or identifying information about another person without that
person's explicit consent;
- that is false, deceptive, misleading, deceitful, mis-informative, or constitutes
"bait and switch";
- that infringes any patent, trademark, trade secret, copyright or other proprietary
rights of any party, or Content that you do not have a right to make available under
any law or under contractual or fiduciary relationships;
- that constitutes or contains "affiliate marketing," "link referral code," "junk
mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
- that constitutes or contains any form of advertising or solicitation if (1) posted
in areas of the Wheelersgate sites which are not designated for such purposes; or
(2) emailed to Wheelersgate users who have requested not to be contacted about other
services, products or commercial interests;
- that includes links to commercial services or web sites, except as allowed in "services";
- that advertises any illegal services or the sale of any items the sale of which
is prohibited or restricted by applicable law, including without limitation items
the sale of which is prohibited or regulated by Singapore law;
- that contains software viruses or any other computer code, files or programs designed
to interrupt, destroy or limit the functionality of any computer software or hardware
or telecommunications equipment;
- that disrupts the normal flow of dialogue with an excessive number of messages (flooding
attack) to the Service, or that otherwise negatively affects other users' ability
to use the Service;
- that employs misleading email addresses, or forged headers or otherwise manipulated
identifiers in order to disguise the origin of Content transmitted through the Service;
any other activities, contents and materials which in the opinion of Wheelersgate
deemed improper or inappropriate or are injurious to the reputation of this Site
in its sole absolute discretion.
Additionally, you agree and undertake not to:
- contact anyone who has asked not to be contacted;
- "stalk" or otherwise harrass anyone;
- collect Personal Information about other users for commercial or unlawful purposes;
- use automated means, including spiders, robots, crawlers, data mining tools, or
the like to download data from the Service - unless expressly permitted by Wheelersgate;
- post non-local or otherwise irrelevant Content, repeatedly post the same or similar
Content or otherwise impose an unreasonable or disproportionately large load on
our infrastructure;
- post the same item or service in more than one classified category or forum, or
in more than one metropolitan area; or
- attempt to gain unauthorized access to Wheelersgate computer systems or engage in
any activity that disrupts, diminishes the quality of, interferes with the performance
of, or impairs the functionality of, the Service or the Wheelersgate.
